Law360 interviewed Blackwell Burke P.A. attorney Brendan M. Kenny for a recent article discussing product liability cases that court watchers will be following in 2015. Mr. Kenny identified the most recent developments in the Engle personal-injury litigation in Florida, where the Florida Supreme Court is being asked to resolve a split among Florida appellate courts by considering a question that will affect the course of thousands of suits spawned by the decertified Engle class: whether punitive damages on strict liability and negligence claims in their individual suits are barred. Mr. Kenny explained that Florida appellate courts disagree over whether current plaintiffs should be allowed to seek punitive damages even though the lead plaintiffs in the Engle case had not made timely claims for punitive damages under those theories.
