Overview

Orian Southall practices in the areas of products liability and complex commercial litigation. She has an extensive background in toxic tort litigation and trial practice and is licensed in six states as well as the District of Columbia. Ms. Southall’s practice includes the defense of clients with multiple product liability claims involving a single product or family of products. She works actively with the firm’s clients and attorneys to develop a global strategic framework for the defense of multiple, similar claims.

Ms. Southall is a member of various state and national bars and donates her time to several women’s organizations. Ms. Southall offices primarily in Atlanta, Georgia.

When she is not zealously defending clients, Ms. Southall enjoys painting and traveling.

Representative Cases

  • Flushable Wipes Class Action.  Won complete summary judgment for Rockline Industries, Inc., one of the largest global producers of wet wipes in action in Minnesota Federal District Court alleging that flushable wipes were clogging sewer systems. The District Court agreed with the defense that its claims were not false or misleading, and denied plaintiffs injunctive relief.

  • Yo-Plus Consumer Class Action.  Member of team that defended General Mills, Inc. against a class action, on behalf of California purchasers, alleging that contrary to its advertising, Yo-Plus probiotic yogurt does not promote digestive health.  Blackwell Burke obtained de-certification of the class’s claims for damages, including its claim for punitive damages. The case settled shortly after the de-certification decision.

  • Khoury v. ConAgra Foods.  Successfully defended international food manufacturer Conagra Foods, Inc. in action in which consumers claimed disease from exposure to microwave popcorn vapors.
